Suspects in custody after shooting at tow truck driver

CHARLOTTESVILLE, VA (CVILLE RIGHT NOW) – Albemarle County Police have arrested two people after a tow truck driver reported being shot at early Tuesday morning.

Marquice A. Waller, 36, has been charged with two counts of attempted malicious wounding, two counts of using a firearm in the commission of a felony, and possession of a firearm by a convicted felon, ACPD announced Tuesday.

Waller and 27-year-old Octavia S. Williams were both charged with possession of stolen property after a firearm reported stolen in the county in July was recovered from a purse belonging to Williams.

The incident occurred at 1:45 a.m. on the 2400 block of Peyton Drive. ACPD recovered two shell casings from the scene. There were no injuries reported. The tow truck driver left the scene with the car he was towing, then reported the incident to the police.

Waller and Williams then showed up at the tow yard, according to the release, attempting to retrieve the towed vehicle, and were taken into custody. They are being held at Albemarle-Charlottesville Regional Jail.

“A tow truck driver reported that while towing a car from the apartment community, they were shot at by a male suspect,” ACPD announced in a release. “The driver had relocated to their company’s towing lot in the City of Charlottesville, where ACPD and Charlottesville Police Department (CPD) responded to meet with the victim. … While officers were on scene at the towing lot, two individuals arrived to retrieve the vehicle involved in the incident.”
